Real Estate

For many clients, ownership of real estate is one of the most significant investments they will make in a lifetime. When others involved in the transaction are pressing to complete the sale or loan, we focus on protecting the client and making sure the transaction is fully understood. With an extensive knowledge of and involvement in our local community, we also take seriously our opportunity to assist in making a welcome transition for clients who are becoming new residents or business owners in the Swannanoa Valley.

Our real estate attorney (more than thirty years experience) and certified paralegal (more than twenty-five years experience) have worked together since 1985. We offer assistance in a comprehensive range of real property activities, including residential and commercial sales and purchases, loans, leases, contracts, easements and rights of way, boundary disputes, construction, development, homeowners associations, family ownerships and succession planning.

Estate Planning

From the first client contact, our goal is to earn and maintain a long-term relationship of trust as your counselor of choice. Our firm offers an experienced team for guiding and resourcing clients in matters of both lifetime and succession planning. With a sensitivity to family dynamics and a focus on your concerns and goals, we strive to craft your documents to fit your circumstances. We take great pleasure in creating family solutions for complex relationships whether your estate is large or small.

Our estate attorney has a breadth of training and practice experience, and he is ably assisted by support staff with years of CPA experience. We advise clients regarding wills, powers of attorney, health care powers of attorney and living wills. Often an estate plan may best be accomplished using trusts, and we advise clients regarding a wide array of revocable, irrevocable and charitable trust choices. We assist clients in developing plans appropriate for second marriages, minor beneficiaries, sharing family properties, diminishing or managing family conflict and many other special circumstances. We offer premarital agreements, planning for health transitions and strategies for the elderly with diminishing resources. We represent aging clients with a special welcome and compassion. Our advice includes tax analysis and methods to minimize the costs of estate settlement.

Estate Settlement and Probate

Helping a family or surviving spouse with settling the estate of a recently deceased loved one is understood as a special relationship. We know that clients often come to us with anxieties about the time, expense and complexity of probate and non-probate administration. Misplaced fears of governmental bureaucracy abound. Our first and continuing service is to transfer those stresses from the client. From the outset, we reassure the client that our firm promptly and effectively fulfills the legal requirements, implements the transfer planning of the decedent and makes the process understandable. Throughout the settlement process, we strive to make those reassurances a continuing reality.

Our estate administration team of an experienced attorney and CPA support staff guide and advise Executors, Trustees and beneficiaries through the settlement process, identifying opportunities to save expenses, create solutions and present understandable choices to the client that may result in a significant reduction of income taxes or more workable family use or distribution of properties. Our team equips you with extensive knowledge and experience in handling appraisals, inventories, accountings, relationships with beneficiaries and management of a comprehensive range of assets such as trusts, retirement accounts, pension and death benefits, life insurance, individual or shared ownership interests in a business, real estate located in North Carolina or another jurisdiction, antiques, collectibles, and money owed to the decedent.
